These Terms and Conditions ("Terms") govern your access to and use of lumafront.com and any related products, dashboards, APIs, and automation services provided by LumaFront ("LumaFront", "we", "us", or "our"). By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree, you must not use our website or services.
Company and Services
LumaFront is an automation programming company that enables businesses to manage compliant outreach, including voice calls and SMS/MMS messaging, using configurable campaigns, call flows, and virtual assistants. We provide technology, infrastructure, and tooling; we do not act as your legal advisor or assume responsibility for how you choose to use our platform.
Use of Our Platform
You may use our platform only for lawful business purposes, in accordance with these Terms and all applicable laws, regulations, carrier policies, and industry guidelines. You are responsible for all content, campaigns, contacts, and traffic originating from your accounts, credentials, or integrations.
You agree that any phone numbers, email addresses, or other contact data loaded into or used with LumaFront:
- Belong to individuals or entities that have provided appropriate and verifiable consent to be contacted by you, where required.
- Were collected in a transparent manner, including in-person events, forms, or other channels that disclosed who you are and the types of communications to be sent.
- Are not acquired from unauthorized third-party lists, harvested databases, or sources that conflict with applicable regulations or carrier rules.
Messaging, Toll-Free Numbers, and Compliance
Our services may support messaging over long codes and toll-free numbers (including 8XX numbers). Use of any messaging-capable number through LumaFront is subject to strict compliance requirements designed to protect message recipients and network integrity.
By using our messaging features, you agree to:
- Send messages only to recipients who have provided valid consent for the specific type of messages (for example marketing, informational, or alerts).
- Clearly identify your business or your client's business in message content so recipients know who is contacting them.
- Include clear opt-out instructions in applicable messages, such as "Reply STOP to opt out" and "Reply HELP for help" where required.
- Honor STOP, END, CANCEL, UNSUBSCRIBE, and QUIT requests promptly, and treat them as revocation of consent for the related program.
- Ensure opt-in records, message samples, website disclosures, and actual traffic remain consistent with the described use case and program details.
- Comply with all relevant guidelines (including but not limited to CTIA, carrier policies, and applicable privacy and communications laws).
LumaFront may require or implement verification, vetting, limits, or additional documentation for certain traffic, use cases, or sender identities, including toll-free verification requirements. We may suspend, block, or restrict traffic that appears non-compliant, high-risk, misleading, or harmful.
Prohibited Content and Conduct
You must not use LumaFront to send or facilitate content or campaigns that are fraudulent, misleading, abusive, or illegal. Without limitation, the following are prohibited under these Terms and may result in immediate suspension:
- Unsolicited bulk messaging without valid consent or in violation of anti-spam laws.
- Phishing, impersonation, scams, or deceptive marketing practices.
- Content involving hate, threats, harassment, or incitement of violence.
- Promotion of explicit or exploitative sexual content.
- Promotion of activities restricted or disallowed by carriers or applicable law, including certain high-risk financial schemes, unlicensed loan offers, illegal substances, and unlawful gambling.
- Third-party lead generation or list brokering where recipients did not directly consent to your specific program or brand.
- Use of public URL shorteners or obfuscation tactics that reduce transparency of destination links in violation of carrier or industry rules.
Data Protection, Security, and Mobile Information
We design our services to protect the confidentiality and integrity of information processed through LumaFront. We apply access controls, logging, and other safeguards to help prevent unauthorized use or disclosure.
We treat mobile numbers, consent records, and messaging logs as sensitive information:
- We do not sell or share mobile subscriber information with third parties for their own promotional or marketing purposes.
- We use mobile numbers and related data only to operate, secure, and support messaging programs, to enforce these Terms, and to comply with legal and carrier requirements.
- Where we engage infrastructure or carrier partners to deliver communications, they are permitted to use such data only as necessary to provide those services.
Your use of our services is also subject to our Privacy Policy, which explains in more detail how we collect, use, and safeguard information. In the event of any conflict between these Terms and the Privacy Policy regarding data handling, the provisions that provide stronger protection for individuals' information will be interpreted to apply, to the extent permitted by law.
Customer Responsibilities
You are solely responsible for:
- Ensuring that your use cases, scripts, and sample messages accurately describe the communications you send.
- Providing accurate brand, domain, and contact information for verification and registration purposes.
- Maintaining records of consent and opt-out requests.
- Promptly updating any information that becomes inaccurate or misleading.
- Configuring campaigns, limits, schedules, and content in a way that respects recipients' expectations and local laws.
Service Availability and Changes
We work to maintain reliable and secure services, but availability may be affected by maintenance windows, network conditions, carrier partners, or events beyond our control. We may modify, suspend, or discontinue any feature or component of the services when necessary for security, legal compliance, platform integrity, or business reasons.
Intellectual Property
All software, tools, workflows, text, and other materials provided by LumaFront, excluding your own content, are owned by or licensed to LumaFront and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the services as provided under these Terms. You may not copy, modify, reverse engineer, or redistribute our platform except as expressly permitted in writing.
Disclaimers
The services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that messaging or call delivery will be uninterrupted, timely, or error-free, as delivery may depend on third-party networks and carriers.
Limitation of Liability
To the maximum extent permitted by law, LumaFront shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising out of or in connection with your use of or inability to use the services, even if we have been advised of the possibility of such damages.
Our total aggregate liability for any claim arising out of or relating to the services or these Terms shall not exceed the total amount paid to LumaFront by you for the services giving rise to the claim during the three (3) months preceding the event giving rise to the claim.
Indemnification
You agree to defend, indemnify, and hold harmless LumaFront, its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the services, (b) your violation of these Terms, (c) your violation of any law or regulation, or (d) your communications, campaigns, or data practices.
Governing Law and Disputes
These Terms are governed by the laws of the jurisdiction in which LumaFront is organized, without regard to its conflict of law rules, unless a different governing law is required by mandatory local law. Any disputes arising out of or in connection with these Terms or the services shall be resolved in the competent courts of that jurisdiction, unless otherwise required by applicable law.
Changes to These Terms
We may update these Terms when we improve our services, adjust to legal or regulatory changes, or enhance security and compliance controls. The effective date at the top will indicate the latest revision. Your continued use of the services after any update constitutes acceptance of the revised Terms.
